Azerbaijani govt. to punish employers violating workers' rights

The employers in Azerbaijan who violate workers rights and employ them without concluding labor contracts may be sentenced to imprisonment for three to seven years.

The amount of fine to be applied against the employers (physical and legal entities) for employing people to work prior to enforcement of their labor contracts will stand at 3,000-25,000 manats, Azerbaijan's Ministry of Labor and Social Protection of Population said on August 14.

Based on recent amendments to the Labor Code of Azerbaijan, employers should register the labor contracts in the electronic information system of the Ministry.

The employers are required to have an enhanced electronic signature for the registration of labor contracts in the system.

The amount of fine to be applied against employers - physical entities, for involvement of people to work prior to the entry of the labor contract into force, will be from 1,000 to 3,000 manats, employers - officials - from 3,000 to 5,000 manats, and employers - legal entities - from 20,000 to 25,000 manats.

In accordance with Article 162-1 of the Criminal Code of Azerbaijan, the employers may be fined from 3,000 to 7,000 manats, or imprisoned for up to three years for involving a large number of persons to work prior to enforcement of their labor contracts.

In the case of repeat of such acts, the employers may be imprisoned for a term of three to seven years.

State Labor Inspectorate under the Ministry of Labor and Social Protection of Population organizes "help desks" in the various regions of Azerbaijan to assist employers. Also, the Ministry provides support to employers to register the labor contracts in the electronic information system via a hotline 142.

The employers, who want to register the labor contracts in the electronic information system, can hire the services of the portals www.e-gov.az and www.mlspp.gov, as well as the hotline 142 of the Ministry.

Legalization of illegal employment is one of the main priorities of Azerbaijan's social policy.

Protection of employers' rights is the main task and the most important directions of the state policy of Azerbaijan, which has made significant economic progress in recent years by successfully reducing the poverty level from 50 to five percent and decreasing the unemployment rate significantly to about five percent.

The labor contract and its termination are electronic documents of the employer that should be included in the electronic database of the Ministry of Labor and Social Protection of Population. The labor relations do not start with the conclusion of the labor contract, but on the date of registration of notification on labor contract in the electronic system.

The electronic information system is a significant contribution to combating against illegal employment. It allows increasing the volume of revenues of the state budget, increasing the fees for compulsory social insurance and better protecting the rights of workers.
