MPs mull changes to Labour Code

The Parliamentary Committee on Labour and Social Policy discussed changes to the Labour Code of Azerbaijan.

The changes cover conclusion of labour contracts and terms for notification of workers about dismissal from work.

Under the changes, urgent labour contracts will be concluded on the basis of mutual consent of both parties. The employer can conclude an unlimited or fixed-term employment contract with the employee. A fixed-term employment contract may be concluded for a period agreed upon between the employee and the employer.

Currently, an unlimited contract or a five-year contract is concluded between the parties.

Another change concerns the timing of notification of workers about the dismissal from work within a mass cutback.

In case of mass reduction or termination of the contract, the employer must notify the employee about the dismissal: before two calendar weeks - in case the employee's work experience is less than 1 year, before four calendar weeks - if the length of service is from 1 to 5 years, for six calendar weeks - if the work experience is from 5 to 10 years, for nine calendar weeks - if the work experience is more than 10 years.

Under the current legislation, employees shall be officially notified by the employer two months in advance. During this time the worker should have one day off so that he/she can look for work. The employee must receive the same salary.

When he leaves, he is paid compensation in the amount of the average monthly salary. If an employee has not been able to find work for several months, then he can receive the average monthly salary from his previous job for the second and third months.
