European court fines Azeri govt over jailed Azpetrol boss’ rights

A European court has issued a ruling ordering compensation for the former head of Azerbaijani gasoline retailer Azpetrol Rafig Aliyev, who is in prison over embezzlement.

After a plea was filed by the defense, the European Court of Human Rights ruled that the Azerbaijani government is to pay Aliyev 7,000 euros for moral damages and 25,000 euros to cover his expenses, claiming that several clauses of the European convention on human rights had been violated, according to the ECHR website.

ECHR charged that Aliyev’s pre-trial detention in Baku was marred by violations and that his appeals had not been properly reviewed.

The court also said this was not its final ruling and the sides might submit their appeals to its upper chamber.

The Azpetrol boss was arrested in late 2005 along with his brother, former economic development minister Farhad Aliyev, on charges of graft, abuse of power and other economic crimes. Rafig Aliyev was convicted to nine years in prison in October 2007.
