Azerbaijan's Cabinet of Ministers has passed a decision to approve the "Rules on the transportation of arrested persons by air".

According to the regulations, arrested persons will be accompanied by a special body of the Ministry of Justice's Penitentiary Service such as an escort battalion, representatives of the Ministry of National Security, the Ministry of Internal Affairs and the State Border Service on civilian aircraft.

The State Civil Aviation Administration, Aviation Flights Security Service, the air transport police and the authorized representative of the airline are notified at least within 24 hours that an arrested person would be transported by a civilian aircraft.

If additional flights are arranged for the transportation of the arrested persons, this information should be provided at least within five working days.

The name, surname and other information about the arrested person, as well as the number of guards, their names, trip route, flight number and other relevant data should be provided to the aviation authorities in writing. In case these conditions are not met, the arrested person will not be transported by an aircraft.

The arrested person also has the right to decline transportation by air due to psychological or other health problems.

If there are no other specified conditions, the detainee is escorted by two guards, while particularly dangerous criminals must be escorted by three guards. It is prohibited to transport more than one arrested person on civilian aircraft. If a separate aircraft is ordered for the transportation of the arrested persons their number is determined by the bodies whose representatives are escorting them.

According to the rules, transportation of the arrested persons to and from the aircraft will be carried out by special vehicles. The arrested are transported in handcuffs. The exceptions are pregnant women, women with children under three years old, minors, and persons with disabilities (on the condition that they do not pose a threat to themselves or others).
