Azerbaijan to toughen punishment for falsification of control marks

The punishment for falsification, illegal use and sale of control marks is expected to be toughened in Azerbaijan, according to relevant amendments to the domestic legislation.

The amendments to the Code of Administrative Offenses and the Criminal Code were discussed at a session of the social policy committee of the Milli Majlis (Azerbaijani parliament) on Tuesday.

The draft amendments were proposed to the parliament by Azerbaijani President Ilham Aliyev.

According to the proposed clause to be supplemented to the Criminal Code, if as a result of intentional destruction, falsification, illegal preparation, use and sale of control marks significant damage was inflicted, the violator will face a fine in the amount of 3,000 manats (over $3,800) or community work from 320 to 480 hours. If the violation reoccurs, and the violator conspires with several other people or an organized group, with significant damages inflicted, punishment is envisaged in the form of a fine worth 7,000 manats or a prison sentence of two to four years.

According to the new amendments to the Code of Administrative Offenses, in case of destruction, falsification, illegal preparation, use or sale of control marks, the utilized and sold control marks are to be confiscated, along with materials, equipment and other means used to prepare and disseminate them. Persons who committed the offence will be punished with a fine of 1,000 manats, while officials will be fined in the amount of 2,000 manats, and legal entities will pay 3,000 manats.

The draft amendments were suggested for consideration at the plenary session of the parliament.
